GENERAL TERMS OF BUSINESS

We wish to inform our clients that the following Terms and Conditions constitute the basis of a legal contract between both parties:

TERMS OF PAYMENT

–          30% of the total amount for the confirmation of the reservation – at the confirmation,

–          60% of the total amount 60 days before the arrival,

–          10% of the total amount 15 days before the arrival.

In the case of delay payment we are entitled to charge statutory default interests.

Bank fees are to be paid by the client

Should above deadlines not to be adhered to, Mercury Travel Group  has the right to release space automatically.

  1. Cancellation Fees

Cancellation Fees – based on the agreement and the booked provider

General cancellation policy

–      Within  90 days in case of cancellation, no penalties will be applied;

–      From 90 to 30 days cancellation per person – 30% of the total amount will be charged;

–      From 30 to 7 days cancellation per person – 75% of the total amount will be charged;

–      Less than 7 days cancellation per person – 100% of the total amount will be charged;

  1. Rooming list and meal arrangements should be available 7 days prior to arrival at the latest.

All bookings, alterations and cancellation are subject to written confirmation. In the case of “Force Majeure” the Mercury Travel Group reserves the right to withdraw from any commitment. No valid claim for damages can be made in this case.

BOOKINGS:

Booking will be accepted as long as the service in question is available. Booking will be considered as confirmed only after receiving a signed reconfirmation – a contract – by email. The contract means that the client has accepted the general conditions listed below, mainly those concerning the price, cancellation and payment conditions.

Upon RECEIVING booking confirmation we will send pro forma invoice. Invoice has to be paid before departure of the assigned tour – terms of payment apply. All additional changes have to be made two weeks before departure, thus our pro forma invoice can be changed accordingly.

BOOKING CONFIRMATION:

Upon RECEIVING FULFILLED booking form, you will RECEIVE our written confirmation. With written confirmation we guarantee all services as per our program.

  1. APPLICATION AND CONFIRMATION
    After receiving the proposal of Mercury Travel Group. (the “agent”), you (the “client”) are required to confirm in writing, by letter, Email acceptance of our reservation and prices.
  2. CONDITIONS OF CONTRACT
    The contract between the “client” and the “agent” must be finalized in terms of a written agreement. Any new terms, wishes or changes made, must be confirmed in writing.
  3. TRAVEL CONTRACT
    The contract between the “client” and the “agent” is formed by a written confirmation by Mercury Travel Group  It is possible to break the contract free of charge within the cancellation period, 80 days prior to the performance of the contract.

Passports & visas:

A valid passport is required of all tour participants. It must be valid six months after date of return. Your travel agent can help you obtain the necessary forms for passport application.

All passengers, regardless of the passport they hold, should check with the appropriate consulates to determine if any visas are needed. Securing any needed visas is the responsibility of the tour participant.

DELAYED ARRIVAL:

We do not cover any refunds for missed flights or late arrivals and subsequently late start/no start of the tour. ALL ADDITIONAL COSTS HAVE TO BE SETTLED ON THE SPOT BY PASSENGERS.

LOST LUGGAGE:

We do not guarantee that the LUGGAGE will be found and DELIVERED to assigned hotel. We will provide ASSISTANCE on the spot (through our tour director and local offices) that will help the passenger COMMUNICATE with Air Company.

CLAIMS:

Any claim has to be communicated to our agency during the stay or within a maximum of 7 days after the departure. No claim will be accepted afterwards.

LEGAL JURISDICTION:

Negotiation is considered a general method of solving problems or discrepancies concerning the fulfillment of the contract. In case that the results of such negotiations are not found satisfactory by either of the parties, courts in the New Zealand  are considered the courts of appeal and arbitration.

Revision fee:

Revision fee of US$20 per transaction alterations or revisions will be charged. A change of tour date or tour itinerary within 55 days of departure will be treated as a cancellation and new booking; regular cancellation fees apply.

Insurance:

Mercury Travel Group. strongly recommends insurance to cover cancellation charges, trip interruption, and accident and baggage loss. Mercury Travel Group accepts no responsibility for damage or loss of baggage or other personal property.

HEALTH REQUIREMENTS:

Tour participants should check with the consulates and local health boards for the latest health requirements.

No medical EXPENSES will be covered for ILLNESSES that occur prior to arrival or on the tour.

Travelers who need special assistance:

Any disability requiring special attention must be reported to a MTG Rep at the time of booking. Mercury Travel Group will make reasonable efforts to accommodate the special needs of disabled tour participants, but is not responsible for any denial of services by carriers, hotels, lodges, restaurants, or other independent suppliers, nor any additional expenses incurred. Motor coaches and minibuses are not equipped with wheelchair ramps. We regret we cannot provide individual assistance to a tour member for walking, dining, getting on/off motor coaches and other transportation vehicles, or other personal needs. Travelers who need assistance must be accompanied by a qualified and physically able companion. Motorized scooters are unsuitable for touring.

PROGRAM PRICES:

Program prices are per person, based on two persons sharing a room, unless stated otherwise. Single room supplements and triple room reductions are listed where applicable.

ACCOMMODATIONS:

Hotel descriptions are based on local CLASSIFICATIONS, which vary from COUNTRY to country. Please note that standard policy is that hotel rooms are available for check in AFTER 14.00 or in some hotels after 15.00 hours. EARLY check in needs to be advised in advance. And check out usually is by 10.00 or 11.00 hours. Also please note that Mercury Travel Group cannot guarantee that EARLY check in will be free of charge, since the standard policy is that early check in REQUIRES a pre night to be booked and paid for.

Meals on tour:

As specified in each itinerary. Meals are based on the hotel’s or restaurant’s buffet or set menu. In general, beverages are not included, unless specifically stated.

Transfers:

Transfers are provided as indicated for each tour by car, minibus, or motor coach. If you deviate from the arrival and/or departure dates as stated in the itinerary, you may purchase the transfer service prior to your final tour payment date. Your arrival transfer is guaranteed for up to one hour from your scheduled arrival time in order to compensate for minor delays. Mercury Travel group or the transfer company will not be responsible for flight delays, for any reason, beyond one hour from your originally scheduled arrival time. In case of a delay, whether due to flight delay or time spent reporting baggage damage or loss, it will be your responsibility to make other transfer arrangements such as a taxi. Transfer costs are not refundable and any additional expenses will be your responsibility.

Smoking:

Smoking is not allowed in any public area.

Baggage:

Porterage is not included in the price. Most airlines impose a weight and size restriction on baggage and will charge additional fees if these restrictions are exceeded. Please check with the applicable airline(s) regarding airline baggage allowances for your vacation program.

TRAVEL DOCUMENTS:

No responsibility is accepted for loss of or damage to travel documents or any of passenger’s BELONGINGS.

REFUNDS FOR UNUSED SERVICES:

No refunds will be made for unused services once travel arrangements have commenced, especially in the cases where passengers are unable to travel due to invalid travel documents (PASSPORTS, visas), unused portion of services which are included in tour price and program, unused transfer services. Any complaint while traveling should be made IMMEDIATELY to local REPRESENTATIVES (hotel management, tour director…).

CHANGES TO ITINERARIES:

If necessary for any reason beyond our control Mercury Travel Group can amend or cancel any of the arrangements for particular itinerary.

CANCELLATION:

All cancellations must be made in writing. Cancellation charges will apply regarding to the remaining time prior to departure.

OVERBOOKING:

Mercury Travel Group. reserves the right to change or modify a reservation in case of circumstances caused by conditions beyond its control that cannot be predicted, avoided or rectified. Booked accommodation can be substituted only by an accommodation unit of the same or higher category and at the price confirmed during booking, provided that customer is notified ahead of time.

Locality Business Terms :

Mercury Travel Group offices and representatives hold different business terms due to its locality laws. Please refer to each office and representative business terms for more details.

Safety:

Please be aware that during your participation in tours operated by Mercury Travel Group, certain risks and dangers may arise beyond our control including, but not limited to, the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft or other means of transportation; the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities. Mercury Travel Group will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Mercury Travel Group. will use its best efforts to ensure that adequate measures are taken.

Responsibility:

Mercury Travel Group and/or its agents act only in the capacity of agent for the passengers in all matters pertaining to the tour, whether by plane, rail, motor coach, ferry, cruise ship or any other means of conveyance. They shall not be liable for any injury, damage or loss caused by neglect or default of any company or person engaged in conveying the tour, or any hotel proprietor or other person supplying services or material in connection with the tour. Mercury Travel Group. reserves the right to withdraw a tour, refuse to accept or retain any person as a member of a tour at any time, or to make changes in the published itinerary, whenever in their sole judgment conditions warrant or if they deem it necessary for the comfort, convenience or safety of the passengers. All prices are based on tariffs in effect at the same time of publication and are subject to reconfirmation at the time of booking. Refunds for any portion of the tours not taken will be made by the operator on the cancelled portion, less the expenses incurred in the handling. All requests for refund of unused services, etc. must be sent to Mercury Travel Group and/or its booking agent, in writing, no later than 8 days after completion of relevant program. Mercury Travel Group shall be released from any liability under the guarantee to such participant who does not file a timely claim.
